How to Submit a Takedown Notice

To be valid under the DMCA (17 U.S.C. § 512(c)(3)), your written notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material on the site (e.g., a direct URL to the content).
  4. Your contact information, including your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

How to Submit a Counter-Notice

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g)(3). Your counter-notice must include all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if outside the United States, any judicial district in which Nepal Postings LLC may be found.

Repeat Infringer Policy

Nepal Postings LLC has a policy of terminating the accounts of users who are repeat infringers of copyright in appropriate circumstances. A user who repeatedly posts content that is the subject of valid DMCA takedown notices will have their account permanently suspended.

Warning Against False Claims

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. Do not submit a DMCA notice if you are not certain that the material infringes your copyright.
